Rules and Liability Waiver Information

Event:                   Alabama Veteran Annual Big Bass Fishing Tournament

Location:           245 Beeswax Park Road, Columbiana AL, 35051

Time:                  4:30-5:00 a.m. Checkin

 

 

Tournament Rules

 

  1. Tournament hours are from safe daylight until 3:00 pm.  All boats must be inside the buoys at the ramp by 3:00 pm.  LATE BOATS WILL BE DISQUALIFIED. 

 

  1. All participants must wear USCG approved life jackets while the motor is running. 

 

  1. Boat captain must have the attached kill switch while the motor is running. 

 

  1. All participants must obey all Alabama water safety rules AND Alabama Fish and Game regulations. 

 

  1. All participants must possess a current Alabama Fishing license. (Will be checked) 

 

  1. No alcoholic beverages will be allowed before, during, or immediately following tournament hours. 

 

  1. All site fish must be hooked inside the mouth, (No snatching, trolling, or live bait)

 

  1. Only 2 Dead fish WILL be counted and weighed. 

 

  1. Five (5) fish limit per boat. Only largemouth or spotted bass twelve inches or longer will be weighed. 

 

  1. All live wells must be empty before tournament hours start. (Will be checked)

 

  1. Absolutely NO live bait. 

 

  1. Polygraph may be administered before payout.

 

  1. All conditions arising, which are not covered in the above mentioned rules, will be resolved by the tournament committee comprised of members of the Alabama Veteran Board. 

 

  1. To protect the integrity of this fundraising event, the tournament director has the right and ability to deny participation to any team or individual angler.

 

  1. Courtesy, safety, sportsmanship and conservation are expected at all times for all participants, sponsors, volunteers, and tournament committee members. This includes cooperation with all federal, state and local laws, and officials in the courteous and accurate manner, if approached by any of the aforementioned. 

 

 

Release of Liability Waiver

 

WHEREAS, Alabama Veteran is hosting their first annual fishing tournament event (hereinafter, “the Event”), and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Undersigned agrees to the following: 

The Undersigned agrees to indemnify and hold harmless Alabama Veteran, and any of its employees, directors, officers, agents, sponsors or donors, from any and all fault, liabilities, costs, expenses, claims, demands or lawsuits arising out of, related to or connected with: any incident occurring on or at the water; the course of competition in the Event; the Undersigned ‘s participation and/or attendance in the Event; the lake, buildings, land and premises used in the Event; the Undersigned’s presence on or use of said Premises during the Event; and any and all acts or omissions of the Undersigned. And should any such claim, demand or lawsuit arise or be asserted in any way whatsoever related thereto, whether arising under the laws of the United States or of any State, or under any theory of law or equity, the Undersigned will indemnify and hold harmless Alabama Veteran, from any and all costs, expenses or liability including, but not limited to, the cost of any settlement or judgment made or rendered against the Alabama Veteran, whether individually, jointly, or in solido with the Undersigned, together with all costs of court and other costs or expenses incurred in connection with any such claim, demand or lawsuit, including attorney’s fees.

The Undersigned furthermore waives for himself/herself and his/her executors, administrators, assignees or heirs, any and all rights and claims for damages, losses, demands and any other actions whatsoever, which he/she may have or which may arise against Alabama Veteran, (including, but not limited to any and all injuries, damages or illnesses suffered by the Undersigned or the Undersigned’s property), which may, in any way whatsoever, arise out of, be related to or be connected with: participation and/or attendance at the Event; the Premises, including any latent defect in the Premises; the Undersigned’s presence on or use of said Premises; the Undersigned’s property (whether or not entrusted to the Alabama Veteran); and being on or near the water. Alabama Veteran shall not be liable for, and to the Undersigned, on behalf of himself/herself and his/her executors, administrators, assignees or heirs, and Undersigned hereby expressly releases the Alabama Veteran from any and all such claims.

The Undersigned hereby expressly assumes the risk of entering the Premises and of taking part in activities on the Premises which include, but are not limited to, boating, navigating public waterways in accordance with local, state and federal law, the use of personal fishing gear including but not limited to; rod/reel/sharp objects/knives, hooks, bait and tackle, etc.

The Undersigned furthermore hereby acknowledges and agrees that he/she has read, understands and will at all times abide by all Alabama Department of Conservation and Natural Resources, and/or local government and/or rules and procedures.

This instrument binds the Undersigned and his/her executors, administrators, assignees or heirs.
